Literary works, texts, publications and other original creations available on ders.ink are protected by applicable copyright and intellectual property legislation. In Chile, Law No. 17,336 on Intellectual Property protects the rights that authors acquire by the mere fact of creating their works. Copyright includes moral and economic rights.
Works and Publications
The Works and Publications available on ders.ink constitute literary and/or editorial creations protected by copyright law. Protection falls on the concrete expression of the works and not on the general ideas or abstract concepts that may be found in them.
Author and rights holder
The author is the natural person who performs the intellectual creation. The holder of the economic rights can be the author himself or another person who has legitimately acquired said rights. When applicable, ders.ink will identify the rights holder in each Work or Publication through the corresponding copyright notice.
Use of the works
Unless expressly stated otherwise, the public use of a protected work requires the corresponding authorization from the rights holder when this is required under applicable law. This includes, as appropriate, acts of reproduction, distribution, publication, public communication, making available or transformation of the work. The limitations and exceptions established by copyright law remain in full force.
Quotes and excerpts
The use of fragments, quotes and other uses permitted by the exceptions and limitations established in copyright legislation shall be governed by the conditions and scopes established by said legislation. The inclusion of a permitted quote or fragment does not imply transfer of rights to the original work.
Adaptations and translations
Adaptations, translations and other transformations of a protected work may be subject to the corresponding rights on the original work and, when required, to the authorization of its holder. Derivative versions that constitute an autonomous creation may be subject, in addition, to the rights corresponding to their own author.
Requests for authorization
If you wish to request authorization to use a Work or Publication in a way that exceeds the uses permitted by applicable law, you can make the request through the Contact section of ders.ink. To facilitate its identification and management, select or use as subject: "Request for Authorization". Requests for authorization must be made exclusively through the existing Contact form/section at ders.ink.
Copyright protection is born from the mere fact of the creation of the work and does not depend on it having been published or registered. Registration may constitute a means of proof regarding ownership and certain background of the work, but it does not constitute the origin of protection.
Applicable legislation
Copyright on the contents of ders.ink shall be governed, as appropriate, by applicable legislation and, particularly, by Law No. 17,336 on Intellectual Property of Chile and its amendments.
